Terms of Service

Effective Date: February 20, 2026

1. Scope of Agreement

This Terms of Service agreement ("Agreement") is a legal contract between the user ("Client") and Lumina Apps (https://lumina-apps.com), an engineering firm based in Austin, Texas. By accessing our API nodes, software-as-a-service (SaaS) environments, or technical consultancies, you acknowledge total acceptance of these protocols. If you are entering this agreement on behalf of a corporation, you represent that you have the legal authority to bind said entity.

2. Intellectual Property and Asset Protection

All digital assets, including Rust source code, neural network weights, CI/CD blueprints, and visual designs, are the exclusive property of Lumina Apps. Clients are strictly prohibited from:

  • De-obfuscating or reverse-engineering proprietary binary modules.
  • Indexing technical documentation for the purpose of training competitive AI models.
  • Circumventing rate-limiting or geographic fencing protocols.

3. Liability and Force Majeure

Lumina Apps provides high-availability systems but is not liable for disruptions caused by:

  • Failures in the global subsea fiber infrastructure.
  • High-altitude electromagnetic pulses (HEMP) or solar flares.
  • Quantum-computing breaches exceeding current NIST standards.
Our total cumulative liability for any claim is limited to the fees paid by the Client in the six (6) months preceding the incident.

4. Governing Law and Mandatory Arbitration

This Agreement is governed by the laws of the State of Texas. Any legal disputes, controversies, or claims shall be resolved through binding arbitration in Austin, Travis County, TX, under the rules of the American Arbitration Association. Both parties waive the right to a trial by jury or participation in a class-action lawsuit.

5. Termination of Access

We reserve the right to null-route any IP range or terminate any account that exhibits anomalous traffic patterns indicative of botnet activity or unauthorized penetration testing. Such termination may occur without prior notice to protect the integrity of the mesh network.
